The Service is intended for U.S. users. If you do not agree to these Terms, do not use the Service.

Not a Medical Practice

MyBody4Ever is not a medical practice. We provide a platform that connects users with independent medical groups, providers, and licensed pharmacies. Health care services are provided by independent medical groups and providers. Prescription dispensing is performed by licensed pharmacies.

Changes to the Service and Terms

We may update the Service and these Terms at any time by posting an updated version and revising the “Last Updated” date. Your continued use signifies acceptance of the updated Terms.

Eligibility and Your Responsibilities

• You must be at least 18, or the age of majority in your jurisdiction, to use the Service.
• You agree to use the Service in compliance with applicable laws.
• You must provide accurate information and maintain the security of your account credentials.

Relationship With Medical Groups, Providers, and Pharmacies

We act as a technology platform to facilitate access to products and services offered by independent medical groups, providers, laboratories, and pharmacies. We do not control or influence medical decision-making. Any medical care and treatment is the responsibility of the independent providers and medical groups.

Prescription Products

Certain products require a valid prescription issued by a licensed healthcare provider after a consultation. You may choose where to fill a prescription, including a pharmacy partner or another pharmacy of your choice.

Financial Responsibility

Services and products available through the Service may not be covered by federal, state, or private payor programs. By using the Service, you agree to pay out-of-pocket and not to seek reimbursement from such programs for services or products received through the Service.

Privacy

See our Privacy Policy for how we collect, use, and disclose information. MyBody4Ever is not a covered entity under HIPAA. Some independent medical groups or pharmacies may be covered entities. Certain health information may be protected under applicable laws.

User Conduct

You agree not to use the Service for unlawful purposes, to interfere with its operation, to access data without authorization, or to infringe others’ rights. We may suspend or terminate access for violations.

Intellectual Property

The Service and its content are owned by MyBody4Ever and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal use.

DMCA Notices

If you believe content infringes your copyright, contact support@mybody4ever.com with a notice that complies with 17 U.S.C. §512(c)(3).

Third-Party Goods and Services

Your interactions with third parties, including medical groups, providers, laboratories, and pharmacies, are solely between you and those parties. We are not responsible for any loss or damage arising from such interactions.

Terms of Sale

All products are subject to availability. Prices may change prior to order placement. You authorize charges to your selected payment method for your order, including applicable taxes and shipping. Shipping dates are estimates.

Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR LOST PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED USD $100.

Indemnification

You agree to indemnify and hold harmless MyBody4Ever and its affiliates from claims arising from your use of the Service or violation of these Terms.

Arbitration; Class Waiver

Except where prohibited by law, any dispute arising from or relating to the Service will be resolved by confidential binding arbitration before a single arbitrator administered by the American Arbitration Association under its applicable rules, on an individual basis.

Governing Law; Severability

These Terms are governed by applicable U.S. law without regard to conflicts principles. If any provision is unenforceable, the remainder remains in effect.
